Petme Paid Accounts Terms of Service

Effective as of: December 29, 2024

General Terms Applicable to All Paid Accounts

This document sets forth the terms and conditions (the “Paid Terms”) applicable to Paid Services offered by Zeros Group OÜ (hereinafter referred to as “We/Us/Our/Petme”), registered in the e-Business Register of Estonia under number 16572135, having its registered office at Harju maakond, Tallinn, Kesklinna linnaosa, Ahtri tn 12, 10151, Estonia. By purchasing and using any Paid Services provided by Petme, you agree to comply with and be bound by these Paid Terms.

1. Acceptance

By using or accessing a Paid Service(s) from Petme, submitting payment thereunder, and/or clicking on a button to make a one-time purchase or recurring subscription payments for the Paid Service(s) provided by Petme, you agree to be bound by the Paid Terms. If you do not understand or accept the Paid Terms, you may not use or access any Paid Services.

To purchase and use a Paid Service, you must:

  • Be at least 18 years old or the age of majority as determined by the laws of your jurisdiction.
  • Have the express consent of your parent or guardian to purchase and use that Paid Service if you are under the age of majority. In any case, as stated in the “Who can use the Platform” section of the Petme Terms of Service, you must be at least 16 years old to use the Platform.

If you are a parent or legal guardian allowing a minor to purchase or use a Paid Service, you agree to be bound by these Paid Terms and assume responsibility for ensuring that the minor also complies with them.

If you are accepting these Paid Terms on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Paid Terms. In such cases, the terms “you” and “your” as used herein shall refer to that entity.

2. Contracting Entity

You enter into these Paid Accounts Terms of Service with Zeros Group OÜ, registered in the e-Business Register of Estonia under number 16572135, having its registered office at Harju maakond, Tallinn, Kesklinna linnaosa, Ahtri tn 12, 10151, Estonia. This entity will provide the Paid Services to you.

3. Changes to Terms, Paid Services, and Pricing

3.1. Changes to Terms

Petme may revise these Paid Terms from time to time. The changes will not be retroactive, and the most current version of the Paid Terms (available at  https://petme.social/paid-accounts-terms-of-service/) will govern your use of Paid Services and any corresponding transactions. If material revisions are made, we will notify you in advance through service notifications or email. By continuing to access or use the Paid Services after revisions become effective, you agree to the revised Paid Terms.

3.2. Changes to Paid Services

Our Paid Services are constantly updated and evolving. Petme reserves the right to modify, suspend, or discontinue any Paid Services or features within them, either temporarily or permanently, without notice or liability. In the event of such changes, any cancellation or refund policies specified in these Paid Terms will apply.

3.3. Changes to Pricing

Prices for Paid Services are subject to change. We will provide reasonable notice of any substantial price changes. Subscription service price changes will take effect at the start of the next subscription period following the change. If you do not agree to a price change, you have the right to cancel your subscription before the change takes effect.

4. Payment Terms

4.1. Payment Options

Petme offers various payment methods that may vary depending on your geographic location, device, or operating system. Payments for Paid Services can be made through third-party platforms, including Apple’s App Store, Google’s Play Store, or (if available) directly via Petme’s Website using a secure payment processor. By submitting payment for any Paid Service, you agree to the following:

  • Obligations:
    • You are responsible for providing accurate and up-to-date payment information.
    • All payments for Paid Services are due in advance of accessing such products or services. Payments are non-refundable unless required by applicable law or explicitly stated otherwise in these Paid Terms.
  • Recurring Payments:
    • If you subscribe to a Paid Service with a recurring fee, your subscription will automatically renew at the end of the subscription period unless canceled in accordance with these Paid Terms. By subscribing, you authorize us or our payment processor to charge the applicable subscription fees to the payment method on file at the start of each renewal period.
    • If your payment information is declined, your access to the Paid Services may be suspended or terminated. You must update your payment information promptly to avoid service interruptions.
  • App Store Payments:
    • If you purchase a Paid Service through the Apple App Store or Google Play Store, you agree to comply with all applicable terms and conditions of those platforms, which may include their respective refund and cancellation policies.
    • Subscriptions initiated through the Apple App Store must be managed directly via your Apple account settings. Similarly, subscriptions purchased through the Google Play Store must be managed through your Google account settings. Petme cannot modify, cancel, or provide refunds for subscriptions purchased via these third-party platforms.
  • Direct Payments:
    • For payments made directly via Petme’s Platform, our payment processor will securely handle your transaction. Petme does not store your payment details but may retain transaction data for legal, compliance, and support purposes.
  • Taxes and Fees:
    • You are responsible for any applicable taxes, duties, tariffs, and fees related to the purchase of Paid Services, including VAT, sales tax, or other applicable levies. Taxes may vary based on your location and will be calculated and displayed at checkout. Depending on your location, Petme may collect and remit taxes on your behalf as required by law.
  • Refunds and Cancellations:
    • Refunds for subscriptions initiated via Apple’s App Store or Google’s Play Store must be requested directly through those platforms and are subject to their policies.

5. Privacy and Payment Data:

  • Any private personal data that you provide in connection with your use of the Paid Services including, without limitation, any data provided in connection with payment, will be processed in accordance with the Petme Privacy Policy.
  • Petme may share your payment information with payment services providers to process payments; prevent, detect, and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit cards, debit cards, or ACH.

These payment terms are critical to ensuring transparency and maintaining the integrity of Petme’s Paid Services. If you have any questions regarding payments, please contact support@petme.social.

6. Application of Petme Terms of Service, Termination, and Refunds

6.1. Compliance with Petme Terms of Service

YOU MUST ALWAYS FOLLOW AND COMPLY WITH THE PETME TERMS OF SERVICE AND, IF APPLICABLE, THE PETME FOR BUSINESS POLICY. The Petme Terms of Service apply to all users of the Platform, while the Petme for Business Policy applies specifically to Business Users. These terms govern your use of the Platform, including the Paid Services and features. Your failure to follow and comply with the applicable terms, or Petme’s belief that you have failed to do so, may result in the cancellation of your Paid Services. Any such cancellation will be in addition to, and without limitation of, any enforcement action that Petme may take against you under these terms. In such instances, you may lose the benefits of your Paid Services and will not be eligible for a refund for any amounts you have paid (or pre-paid) for Paid Services.

6.2. Why Petme Might Terminate Your Access to Paid Services

Petme may suspend or terminate your access to Paid Services or cease providing you with all or part of the Paid Services (without any liability) at any time for any or no reason, including, but not limited to, the following reasons:

    • Petme believes, in its sole discretion, that you have violated these Paid Terms or your use of the Paid Services would violate any applicable laws.
    • Petme is requested or directed to do so by any competent court of law, regulatory authority, or law enforcement agency.
    • Petme encounters unexpected technical or security issues.
    • Petme believes you have violated the Petme Terms of Service or Petme for Business Policy.
    • Your actions create risk or possible legal exposure for Petme.
    • Your account is associated with unlawful conduct.
    • Your account is inactive for a prolonged period.
    • Petme determines, in its sole discretion, that providing the Paid Services to you is no longer com mercially viable.

6.3. All Transactions Are Final

All payments for Paid Services are final and not refundable or exchangeable, except as required by applicable law. Petme makes no guarantee as to the nature, quality, or value of a Paid Service or the availability or supply thereof. Refunds or credits are not provided for any unused or partially used Paid Service (e.g., a partially used subscription period).

6.4. Paid Services Are Non-Transferable Between Accounts

Each purchase of a Paid Service applies to a single Petme account, meaning that your purchase will apply solely to the account you were using when you purchased the Paid Service and will not apply to other accounts that you may access or control. If you have or control multiple accounts and want access to Paid Services on each account, you must purchase the Paid Service separately for each account.

6.5. Restrictions and Obligations

    • You may only purchase and use a Paid Service if legally allowed in your country of residence and if Petme supports the Paid Service in your jurisdiction.
    • Petme reserves the right to refuse Paid Services transactions or cancel or discontinue the sale or use of a Paid Service in its sole discretion.
    • You may not allow others to use your Petme account to access any Paid Service they did not purchase.
    • You may not purchase or use a Paid Service if you are a person with whom EU or Estonian persons are not permitted to engage in dealings pursuant to economic sanctions, including sanctions administered by relevant authorities. This includes individuals or entities located in embargoed countries or regions.
    • YOU REPRESENT THAT YOU WILL USE THE PAID SERVICES ONLY FOR LAWFUL PURPOSES AND IN ACCORDANCE WITH THESE TERMS.

6.6. Refunds

All transactions are final, and refunds are not provided except as required by applicable law. Users in Member States of the European Union and the United Kingdom may have specific rights under consumer protection laws, including a 14-day withdrawal period, as outlined in Section 7.

7. Rights for EU and UK Users

If you reside in a Member State of the European Union or the United Kingdom, you have the right to withdraw from your purchase of Paid Services within 14 days of the transaction, subject to certain conditions as specified in the Additional Terms below. 

8. Disclaimers, Limitation of Liability, and Dispute Resolution

8.1. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR ACCESS TO AND USE OF THE PAID SERVICES IS AT YOUR OWN RISK. THE PAID SERVICES ARE PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS. PETME DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Petme makes no warranty or representation and disclaims all responsibility and liability for:

    • The completeness, accuracy, availability, timeliness, security, or reliability of the Paid Services.
    • Whether the Paid Services will meet your requirements or expectations or will be available on an uninterrupted, secure, or error-free basis.

You acknowledge and agree that Petme has no obligation to provide updates, upgrades, or modifications to the Paid Services, and any reliance on the availability or functionality of these features is at your own risk.

8.2. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

    • Your access to or use of or inability to access or use the Paid Services.
    • Any conduct or content of any third party on the Paid Services, including, but not limited to, any defamatory, offensive, or illegal conduct of other users or third parties.
    • Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL PETME’S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU PAID TO PETME IN THE PAST SIX MONTHS FOR THE PAID SERVICES THAT GIVE RISE TO THE CLAIM. THESE LIMITATIONS SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT PETME HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Certain jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, the above limitations may not apply to you to the extent prohibited by applicable law.

8.3. DISPUTE RESOLUTION AND BINDING ARBITRATION

These Paid Terms are governed by the laws of Estonia. By using the Paid Services, you agree that any dispute, controversy, or claim arising out of or relating to these Paid Terms or the use of the Paid Services will be resolved as follows:

    • Initial Dispute Resolution: Most disputes can be resolved informally by contacting Petme’s customer support at support@petme.social. You and Petme agree to attempt to resolve any dispute in good faith within 30 days before initiating formal proceedings.
    • Binding Arbitration: If informal resolution fails, any unresolved dispute shall be finally settled by binding arbitration administered by the Arbitration Court of the Estonian Chamber of Commerce and Industry. The arbitration will take place in Tallinn, Estonia, the applicable law will be Estonian law, and the language of arbitration shall be English.
    • Class Action Waiver: You agree that any disputes will be resolved on an individual basis and not as part of a class, collective, or representative action. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated.
    • Opt-Out: You may opt out of this arbitration agreement by providing written notice to support@petme.social within 30 days of your first use of the Paid Services. Your opt-out will not affect the enforceability of any remaining provisions.

8.4.SEVERABILITY

If any provision of these Paid Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

8.5.NOTICE REGARDING THIRD-PARTY PLATFORMS

If you access or purchase the Paid Services through third-party platforms, such as Apple’s App Store or Google Play Store, you acknowledge that:

    • Petme is solely responsible for providing the Paid Services, and the respective platform is not liable for the Paid Services or their content.
    • Any claims or disputes related to the Paid Services must be directed to Petme, not the platform provider.
    • The platform provider is a third-party beneficiary of these Paid Terms and has the right to enforce these terms against you as a third-party beneficiary.

By agreeing to these Paid Terms, you acknowledge your understanding and acceptance of the above disclaimers, limitations, and dispute resolution terms. If you do not agree, you must cease using the Paid Services.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with Estonian law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia, and more specifically the Arbitration Court of the Estonian Chamber of Commerce and Industry as specified in clause 8.3 above.

Petme Premium Additional Terms

By participating in the recurring subscription service from Petme as a personal account user (“Petme Premium”), you agree that your participation will be governed by and subject to the Paid Terms, including the following Petme Premium Additional Terms.

1. Petme Premium Description

Petme Premium is a recurring subscription service that provides users with access to exclusive features, benefits, and/or services designed to enhance your experience on the Platform. Your subscription to Petme Premium will automatically renew until canceled in accordance with the Paid Terms and these Petme Premium Additional Terms.

a. Features of Petme Premium

  • Fuchsia Verification Check: Premium subscribers receive a fuchsia-colored verification checkmark applicable to their personal account and all their pet profiles. This feature is exclusive to the main pet parent and does not apply to pet relatives.
  • Expanded Hashtag Use: Premium users can include up to five hashtags per post, compared to three for free-tier users.
  • Limited Ad Experience: Premium accounts will not see third-party advertisements (e.g., from Google AdMob or similar services). However, promotional material or advertisements created by Petme Business users may still be displayed.
  • Calming Music for Pets: Gain access to a curated library of calming music specially designed for pets.

2. Sign-up, Managing Your Account, Payment Process, and Auto-Renewal

a. Sign-Up

You must be logged into your Petme account to sign up for Petme Premium. You may subscribe and pay via:

  • Apple’s in-app purchase system (if using an iOS device), 
  • Google Play Store (if using an Android device), or
  • using a secure payment processor on the Petme website (if available). 

b. Managing Your Account

The platform used to sign up and pay for your subscription determines how you must manage your subscription:

  • Apple In-App Purchase: Manage your subscription through your Apple account settings.
  • Google Play Store: Manage your subscription via your Google account settings.
  • Petme Website: Manage your subscription via your Petme app’s settings. 

c. Payment Process and Pricing

  • Recurring Payments: Petme Premium is billed on a recurring basis. You authorize Petme or its payment processor to automatically charge your selected payment method at the start of each subscription period. Payment information must be kept up to date to avoid interruptions to your subscription.
  • Payment Failures: If a payment is declined, you must update your payment information promptly to maintain access. Failure to do so may result in subscription cancellation.
  • Pricing: Subscription pricing is set by Petme and may vary based on your geographic location. Prices are displayed during sign-up and may include applicable taxes. Subscriptions are prepaid, non-refundable (except as required by law), and automatically renew unless canceled at least 24 hours before the renewal date.
  • Pricing Adjustments: Petme reserves the right to adjust subscription prices at any time. You will only be notified of significant price changes, which will apply to the next billing cycle.

d. Upgrading or Downgrading

  • Upgrades: Upgrading your subscription to a higher tier will take effect immediately. Any unused balance from the previous tier will be prorated and credited towards your new plan.
  • Downgrades: Downgrading will take effect at the end of the current billing cycle. No refunds or credits will be issued for downgrades unless required by applicable law.

3. Cancellation and Withdrawal Rights

a. Cancellation

You can cancel your subscription at any time through the platform used for purchase:

  • Apple In-App Purchase: Cancel via your Apple account settings.
  • Google Play Store: Cancel via your Google account settings.

Your subscription will remain active until the end of the current billing period. No refunds or credits will be provided for unused days unless required by law.

b. Withdrawal Rights for EU/UK Consumers

When you purchase a Petme Premium subscription, you expressly agree that the subscription will commence immediately on your date of purchase. If you are a consumer residing in a Member State of the European Union or the United Kingdom, you have a statutory right to withdraw from your subscription within 14 days of purchase without specifying a reason. To exercise this right, follow the refund policies of the platform used to subscribe. Any and all such refunds are handled by Apple or Google, respectively, not Petme, and are subject to Apple’s or Google’s refund policies.

4. No Endorsement or Guarantee of Feature Performance

Petme does not guarantee uninterrupted access to Premium features. Petme Premium features may vary by operating system and geographic location. Access to certain features may be restricted in unsupported regions or on unsupported devices. Features may be added, modified, or removed at any time at Petme’s sole discretion.

5. Promotions and Trials

Petme may occasionally offer promotions or free trials for Petme Premium. These are subject to the same terms as paid subscriptions, with additional terms outlined during sign-up. Trial subscriptions will automatically convert to paid subscriptions at the end of the trial period unless canceled at least 24 hours before the trial ends.

6. No Endorsement of Content

Petme Premium includes tools for promoting content. However, Petme does not endorse, guarantee, or take responsibility for the accuracy, reliability, or quality of any content promoted via these tools. Users are solely responsible for the content they create and promote.

By subscribing to Petme Premium, you agree to these additional terms, which supplement and form part of the Paid Terms. For further assistance, please contact support@petme.social.


Petme for Business Additional Terms

By subscribing to the recurring subscription service for professional accounts on Petme (“Petme for Business”), you agree that your participation will be governed by and subject to the Paid Accounts Terms of Service, the Petme for Business Policy, and the following Petme for Business Additional Terms:

1. Petme for Business Description

Petme for Business is a recurring subscription service designed for businesses to enhance their presence and capabilities on the Petme Platform. The service offers a suite of exclusive features tailored to meet the needs of businesses of all sizes, organizations, and sole proprietors engaged in the offering and/or sale of products and/or services. Your subscription to Petme for Business will automatically renew until canceled in accordance with the Paid Accounts Terms of Service and these additional terms.

a. Features of Petme for Business

Petme for Business subscribers gain access to the following features:

  • Blue Verification Check: Verified businesses will receive a blue checkmark on their profile, signifying a professional account.
  • Enhanced Profiles: Business accounts can showcase their brand with additional profile customization options and branding tools.
  • Product Linking: Subscribers can link products directly in posts, making it easier for users to browse and purchase.
  • Ad Targeting by Species and Breed: Businesses can create targeted advertisements based on species and breed preferences.
  • Basic Analytics: Access to engagement and performance metrics to evaluate the success of posts and campaigns.
  • Priority Support: Gain access to expedited customer support for resolving issues promptly.

2. Sign-Up and Payment

a. Sign-Up

You must be logged into your Petme account to sign up for Petme Premium. You may subscribe and pay via:

  • Apple’s in-app purchase system (if using an iOS device), 
  • Google Play Store (if using an Android device), or
  • using a secure payment processor on the Petme website (if available).

b. Payment Process and Pricing

  • Profile Visibility: Your Business profile will remain invisible to other users and you will not be able to interact with users on the Platform (e.g., posting, liking, commenting, or advertising) until your payment is successfully processed. Once payment is confirmed, all Business Account features will be activated.
  • Recurring Payments: Petme Premium is billed on a recurring basis. You authorize Petme or its payment processor to automatically charge your selected payment method at the start of each subscription period. Payment information must be kept up to date to avoid interruptions to your subscription.
  • Payment Failures: If a payment is declined, you must update your payment information promptly to maintain access. Failure to do so may result in subscription cancellation.
  • Pricing: Subscription pricing is set by Petme and may vary based on your geographic location. Prices are displayed during sign-up and may include applicable taxes. Subscriptions are prepaid, non-refundable (except as required by law), and automatically renew unless canceled at least 24 hours before the renewal date.
  • Pricing Adjustments: Petme reserves the right to adjust subscription prices at any time. You will only be notified of significant price changes, which will apply to the next billing cycle.

3. Managing and Cancelling Subscriptions

The platform used to initiate your subscription determines how it must be managed:

  • Apple: Manage via the Apple App Store.
  • Google: Manage via the Google Play Store.

b. Cancelling Your Subscription

You can cancel your Petme for Business subscription at any time. Cancellation will take effect at the end of the current subscription period. No refunds or credits will be issued for unused portions of the subscription unless required by law.

c. Withdrawal Rights for EU/UK Consumers

When you purchase a Petme for Business subscription, you expressly agree that the subscription will commence immediately on your date of purchase. If you are a consumer residing in a Member State of the European Union or the United Kingdom, you have a statutory right to withdraw from your subscription within 14 days of purchase without specifying a reason. To exercise this right, follow the refund policies of the platform used to subscribe. Any and all such refunds are handled by Apple or Google, respectively, not Petme, and are subject to Apple’s or Google’s refund policies.

  • Subscriptions are tied to a single business account and are non-transferable.
  • Misuse of features, such as spamming or violating user privacy, may result in termination of your subscription and account suspension.
  • Petme reserves the right to modify or discontinue Petme for Business features at its discretion without prior notice.

5. No Endorsement or Guarantee of Feature Performance

Petme does not guarantee uninterrupted access to Petme for Business features. Petme for Business features may vary by operating system and geographic location. Access to certain features may be restricted in unsupported regions or on unsupported devices. Features may be added, modified, or removed at any time at Petme’s sole discretion.
